Wayne NJ Municipal Court Lawyer for DWI & Traffic Tickets

If you were charged with DWI, driving while suspended, reckless driving, leaving the scene of an accident, or another serious traffic offense in Wayne, New Jersey, your case may be heard in Wayne Municipal Court.

Attorney Anthony J. Vecchio, Esq. represents clients facing DWI and traffic charges in Wayne and municipal courts throughout New Jersey.

Our office recently represented a client charged with driving while suspended under N.J.S.A. 39:3-40 in Wayne Municipal Court after a police license-plate-reader alert indicated that the client’s driver’s license was suspended.

After obtaining and reviewing the relevant motor-vehicle records, we established that the client had satisfied the applicable restoration requirements before the police stop.

The driving-while-suspended charge was dismissed.

That result illustrates an important point in many traffic cases: what appears on a police computer at the side of the road does not necessarily establish what the State can ultimately prove in court.

Prior results do not guarantee a similar outcome. Every case depends on its individual facts and evidence.

Driving While Suspended Charge Dismissed in Wayne Municipal Court

In our recent Wayne case, the police officer received an electronic alert indicating that the client’s license was suspended.

Based on that information, the officer stopped the vehicle and issued a summons for driving while suspended under N.J.S.A. 39:3-40.

But the defense did not end with the information available to the officer.

We investigated the client’s actual motor-vehicle history and the steps taken to restore the client’s driving privileges. The records established that the applicable restoration requirements had been satisfied before the stop.

The charge was ultimately dismissed in Wayne Municipal Court.

What if a license plate reader says your license is suspended?

There are potentially two separate issues in a case like this:

1. Did the officer have a lawful basis for making the stop based upon the information available at that time?

2. Can the State prove that the driver’s license was actually suspended when the person operated the vehicle?

Those questions are not necessarily identical.

N.J.S.A. 39:3-40 prohibits operation during an actual period of refusal, suspension, revocation, or prohibition. The underlying MVC history can therefore be critical to determining whether the offense can ultimately be proven.

A defense investigation may require obtaining and reviewing:

  • The certified driver abstract
  • MVC suspension history
  • Restoration records
  • Proof of restoration payments
  • Court records concerning the original suspension
  • Notices from the MVC
  • The date the suspension began and ended
  • Police reports and body-worn camera footage
  • The exact information returned to the officer before the stop

A person should not assume that a driving-while-suspended charge is automatically proven simply because a police database identified the license as suspended.

Wayne Municipal Court Information

The Wayne Municipal Court is located in the Wayne Municipal Building at:

Wayne Municipal Court
475 Valley Road
Wayne, NJ 07470

Phone: 973-694-1800
Fax: 973-694-0898

Wayne currently lists four regular Municipal Court sessions each week:

  • Tuesday at 1:30 p.m.
  • Wednesday at 1:00 p.m.
  • Thursday at 10:00 a.m.
  • Friday at 10:00 a.m.

The court has jurisdiction over motor-vehicle and traffic violations, disorderly persons and petty disorderly persons offenses, municipal ordinance matters, and other matters within municipal-court jurisdiction.

Court schedules can change, so defendants should always follow the date and appearance instructions provided for their individual case.

Is Wayne Municipal Court Virtual or In Person?

Wayne currently states that most Municipal Court matters are conducted virtually through Zoom.

The judge may schedule in-person proceedings individually, including certain trials and motions where the defendant faces a sentence of magnitude.

A defendant should therefore not assume that a case will be either virtual or in person based solely on the type of summons. The notice issued by the court should control.

A virtual appearance is still a court appearance and should be treated accordingly.

Traffic Tickets in Wayne, New Jersey

Wayne has significantly more major-road traffic than many suburban municipalities.

The Township is crossed by Interstate 80, U.S. Route 46, U.S. Route 202, and State Route 23, in addition to major roads such as Paterson-Hamburg Turnpike, Valley Road, Black Oak Ridge Road, Alps Road, Berdan Avenue, Ratzer Road, and Preakness Avenue.

The Route 23, Route 46, and Interstate 80 interchange is sufficiently prominent that Wayne’s own transportation-planning report refers to it as “Spaghetti Junction.”

Wayne’s 2025 transportation report also identified significant concentrations of crashes around:

  • Route 23, Route 46, and Interstate 80
  • Route 23 near Packanack Road
  • Hamburg Turnpike and Alps Road
  • Valley Road and Hamburg Turnpike
  • Valley Road and Ratzer Road
  • Valley Road and Preakness Avenue
  • Route 23 and Ratzer Road

The Township reported that these areas accounted for approximately three-quarters of the crashes reflected in its January 2018 through December 2022 data.

That roadway network means Wayne Municipal Court regularly receives cases arising from major highways, commercial corridors, intersections, and local roads—not simply residential traffic stops.

Wayne NJ Traffic Ticket Defense

Our office represents drivers charged in Wayne with offenses including:

The appropriate defense depends upon the charge, the driver’s history, and the evidence.

For a driving-while-suspended case, MVC records may be crucial.

For an accident-related charge, the defense may focus on witnesses, photographs, surveillance footage, body-camera recordings, or whether the State can actually identify who committed the alleged violation.

For a moving violation, the officer’s observations and available video may become important.

The point is not simply to determine what ticket was issued, but whether the State can prove the elements of that particular offense.

Should You Just Pay a Wayne Traffic Ticket?

Not necessarily.

New Jersey permits certain payable municipal violations to be resolved through NJMCDirect, and Wayne also allows eligible defendants to dispute certain cases through the Municipal Case Resolution process. Wayne specifically advises that a payable violation can be paid through NJMCDirect and provides procedures for entering a not-guilty plea.

Paying a payable ticket, however, is generally a guilty plea.

Before doing so, a driver should understand:

  • How many MVC points the offense carries
  • Whether the conviction can affect insurance
  • Whether the driver already has points
  • Whether the offense carries license-suspension consequences
  • Whether prior convictions increase the potential penalties
  • Whether the driver has a commercial driver’s license
  • Whether the driver is licensed outside New Jersey
  • Whether there is a legitimate factual or legal defense

A relatively small fine can sometimes have consequences that extend beyond the amount printed on the summons.

DWI Charges in Wayne NJ

Wayne Municipal Court also handles DWI charges under N.J.S.A. 39:4-50.

New Jersey’s DWI statute prohibits operating while under the influence of alcohol or specified drugs and also prohibits operation with a blood alcohol concentration of 0.08% or greater.

A Wayne DWI defense may involve issues concerning:

  • The basis for the vehicle stop
  • Whether the State can prove operation
  • Field sobriety testing
  • Police body-camera footage
  • Alcotest procedures
  • Blood or urine testing
  • Drug Recognition Expert evidence
  • Statements attributed to the driver
  • Refusal to submit to breath testing

This Wayne page is not intended to duplicate a complete guide to New Jersey DWI law. Those issues should be addressed in greater detail on the firm’s New Jersey DWI defense, Alcotest, drug DWI, and refusal pages.

The important point for someone charged in Wayne is that the DWI charge should be evaluated based upon the actual evidence—not merely the fact that an arrest was made.

Other Charges Heard in Wayne Municipal Court

Wayne Municipal Court also hears disorderly persons and petty disorderly persons offenses within its jurisdiction.

These may include matters such as simple assault, harassment, disorderly conduct, obstruction, certain theft offenses, criminal mischief, and other lower-level criminal charges.

More serious indictable criminal offenses are handled differently and may proceed through the Superior Court rather than being finally resolved in Wayne Municipal Court.

Every case is different, and prior results do not guarantee a similar outcome.

What if the police computer showed that my license was suspended?

The police computer return should be compared with the driver’s actual MVC history.

The information available to an officer when making a stop and whether the State can ultimately prove that the defendant was legally suspended at the time of operation are separate questions.

Do I have to appear in court for a Wayne traffic ticket?

It depends on the charge.

Certain payable violations can be resolved without a traditional court appearance. Other offenses require court proceedings. Defendants who wish to plead not guilty can also use the available Wayne and NJMCDirect procedures to contest eligible matters.

Should I hire a lawyer for a Wayne traffic or DWI charge?

Not every traffic summons requires private counsel.

Representation deserves particular consideration when a charge involves DWI, refusal, driving while suspended, driving without insurance, potential jail, substantial points, license consequences, or an allegation that can result in enhanced penalties because of prior convictions.
