Probable Cause in New Jersey DUI Cases

Under the United States Constitution, drivers in New Jersey are protected from unlawful police stops and arrests. In a DUI investigation, officers must meet specific legal standards at every stage of the encounter: the initial traffic stop, roadside detention for field sobriety testing, and the eventual arrest.

If police violate these rules, the evidence against you may be suppressed — and in many cases, the prosecution collapses.

Understanding how probable cause works is critical to defending any New Jersey DUI charge.

Reasonable Suspicion to Stop a Driver

A police officer cannot pull over a vehicle on a whim. Under New Jersey law, an officer must have reasonable suspicion that a motor vehicle or criminal violation has occurred.

This is a lower standard than probable cause, but it must still be based on objective facts — not a hunch.

Driving behaviors that may create reasonable suspicion include:

  • Swerving or drifting across lanes
  • Driving significantly below or above the speed limit
  • Running lights or stop signs
  • Erratic braking
  • Near collisions
  • Wrong-way driving
  • Equipment violations
  • Observed traffic infractions

Importantly, courts examine the totality of circumstances. A single observation may or may not justify a stop depending on context.

If there was no objective legal basis for the stop, any evidence gathered afterward — including breath test results — may be suppressed.

Detention for Field Sobriety Testing

A traffic stop does not automatically justify a DUI investigation.

After pulling a driver over, an officer must develop reasonable suspicion of impairment before extending the stop to conduct field sobriety tests.

Courts look for indicators such as:

  • Odor of alcohol
  • Admission of drinking
  • Slurred speech
  • Bloodshot or watery eyes
  • Poor motor coordination
  • Open containers
  • Inconsistent statements

Field sobriety testing transforms a routine traffic stop into a DUI investigation. If the officer lacks sufficient legal justification to escalate the encounter, a defense attorney may challenge the detention through a suppression motion.

Many drivers are unaware that roadside field sobriety tests are not mandatory under New Jersey law. These exercises are investigative tools designed to build probable cause for arrest.

Probable Cause to Arrest for DUI

An arrest requires a higher legal threshold: probable cause.

Under N.J.S.A. 39:5-25, an officer may arrest a person without a warrant if there is probable cause to believe they operated a vehicle while intoxicated.

Probable cause exists when the facts would lead a reasonable officer to believe the driver was impaired. This determination is fact-sensitive and evaluated on a case-by-case basis.

Courts consider:

  • Driving behavior
  • Officer observations
  • Statements by the driver
  • Performance on field sobriety tests
  • Odor of alcohol
  • Physical appearance
  • Presence of alcohol or drugs
  • Breath test results
  • Body camera footage

Probable cause is more than suspicion, but less than proof beyond a reasonable doubt. It is a common-sense judgment based on the entire encounter.

When Courts Suppress DUI Evidence

New Jersey courts regularly suppress DUI evidence when police overstep constitutional limits.

Examples include:

  • Stops based on vague or unsupported observations
  • Extended detentions without legal justification
  • Sobriety testing without reasonable suspicion
  • Arrests lacking sufficient objective evidence
  • Improper investigation procedures

When evidence is suppressed, prosecutors often cannot proceed. A strong defense begins with examining whether the stop and investigation were lawful.

Breath Testing After Arrest

After a lawful DUI arrest, New Jersey’s implied consent law requires drivers to submit to a breath test. Refusal carries separate penalties and license consequences.

However, if the arrest itself lacked probable cause, the breath test may still be challenged as unconstitutional.

The legality of the arrest is often one of the most important issues in a DUI defense.

Why Probable Cause Matters in Every DUI Case

Many people assume a DUI arrest automatically leads to conviction. That is simply not true.

A DUI case is only as strong as the legality of the police investigation. Constitutional violations occur more frequently than most drivers realize. Suppression motions are a powerful defense tool when police exceed their authority.

The earlier a defense attorney reviews the case, the more opportunities exist to identify legal weaknesses.
