Frequently Asked Questions About Mahwah DWI Charges

Where will my Mahwah DWI case be heard?

DWI and other traffic cases arising in Mahwah are heard in the Mahwah Municipal Court at 475 Corporate Drive, Mahwah, NJ 07430. Most DWI cases are resolved in municipal court rather than Superior Court.

Will I lose my driver’s license after a DWI in Mahwah?

A DWI conviction in New Jersey carries a mandatory license suspension — from three months for a first offense up to several years for repeat offenses — plus Motor Vehicle Commission surcharges. A defense lawyer can challenge the traffic stop, field sobriety tests, or breath test results to try to protect your license.

Can a Mahwah DWI charge be reduced or dismissed?

Yes, in some cases. Problems with the traffic stop, breathalyzer calibration or operation, or the required 20-minute observation period can lead to reduced charges or a dismissal. Every case turns on its own facts, so having the evidence reviewed early is important.

What are the penalties for a first-time DWI in Mahwah, NJ?

A first offense with a blood alcohol concentration of 0.08% to 0.10% can bring up to 30 days in jail, fines, Intoxicated Driver Resource Center classes, and a license suspension. Higher readings and repeat offenses carry steeper penalties, so early legal advice matters.

How much does it cost to hire a Mahwah DWI lawyer?

Fees depend on the complexity of the case and whether it goes to trial. The Law Offices of Anthony J. Vecchio offers a free consultation so you can understand your options before making any decisions.

Should I speak with a lawyer before my Mahwah Municipal Court date?

Yes. Talking with a defense lawyer before your court date gives you time to review the evidence, identify possible defenses, and avoid mistakes that could harm your case.
