I’m Anthony Vecchio, New Jersey criminal defense and DUI lawyer. One of the first questions potential clients usually ask when they call the office is: how much is this going to cost? So here’s an honest and detailed breakdown of the typical legal fees associated with defending a DUI.

Most attorneys charge a flat fee to defend a DUI case rather than hourly billing. This helps protect the client so all costs associated with defending the case are known up front and there are no surprises as the case progresses.

For a first offense, the average flat fee is about $3,500. For a second offense, $5,000. And for a third or subsequent offense, $7,500.

Some attorneys charge additionally for motion practice and for trials. Other costs which may be required to properly defend your case would be expert witnesses — whether it’s an Alcotest expert, an expert on standard field sobriety testing, or a medical expert.

Every case is different. If you’re charged with a DUI anywhere in the state, call my office — we can review the facts and circumstances to help determine your best course of action.

Flat Fee vs. Hourly Billing: How DWI Lawyers Charge

Most DWI lawyers in New Jersey charge one of two ways: a flat fee or an hourly rate.

Flat fee. You pay one agreed price for the entire case, no matter how many court appearances or hours it takes. This is how our firm handles DWI defense. You know the full cost on day one, and your lawyer has no incentive to drag the case out — the incentive is to get you the best result.

Hourly billing. The lawyer bills $250 to $500 (or more) per hour for every court appearance, phone call, and email. Because New Jersey municipal courts often schedule multiple appearances, hourly billing can quickly exceed the cost of a flat fee — and you will not know the final bill until the case is over.

What a DWI Defense Fee Typically Includes

A complete DWI defense fee should cover your case from arraignment through trial or plea, including:

  • A full review of the police reports, Alcotest (breath test) records, and dashcam or bodycam footage
  • Every court appearance, from arraignment through trial
  • Motion practice, such as challenging the traffic stop or the breath test results
  • Negotiations with the municipal prosecutor
  • A trial before the municipal court judge, if your case does not resolve by plea

Always ask exactly what is included before you hire a lawyer. Some firms quote a low fee that covers only a guilty plea, then charge extra if you want to fight the case.

What Can Raise (or Lower) the Cost of a DWI Lawyer

Whether the case goes to trial

A case that resolves by plea typically costs less than a full trial, which requires extensive preparation, witness examination, and multiple court dates. Our flat fees above include trial, but many lawyers charge a separate trial fee — ask before you sign.

Prior DWI convictions

Second and third offenses carry mandatory jail time, longer license suspensions, and ignition interlock requirements under N.J.S.A. 39:4-50, so defending them takes more work — which is reflected in higher fees.

Refusal charges, accidents, or injuries

Refusing the breath test adds a separate charge with its own penalties. If the DWI involved a car accident or injuries, the case becomes more complex and the stakes — and the fee — go up.

Expert witnesses

Challenging the Alcotest machine sometimes requires a technical expert, whose fee is usually billed separately from the lawyer’s fee.

Why the Cheapest DWI Lawyer Is Often the Most Expensive Mistake

It is tempting to hire the lawyer with the lowest fee, but a DWI conviction in New Jersey is one of the most expensive outcomes you can buy. Beyond the fine, a conviction can mean $1,000-per-year insurance surcharges for three years, ignition interlock costs, months without a license, and a record that affects employment. A bargain lawyer who simply pleads you guilty at the first appearance may cost you far more than an experienced former prosecutor who fights for a dismissal or a downgrade.

When comparing fees, compare results and experience — not just the number on the quote. DWI cases are heard in New Jersey’s municipal courts, where knowing the local prosecutors and procedures makes a real difference.

Frequently Asked Questions

Do I have to pay everything up front?

Usually not. Most clients pay a portion of the flat fee when they hire us and pay the balance on a schedule we agree to in writing. Ask about payment options during your free consultation — cost should never stop you from getting a strong defense.

Is a public defender free?

Not exactly. In New Jersey there is a public defender application fee (up to $200), and you must financially qualify. Public defenders are dedicated lawyers, but they carry very heavy caseloads. A private DWI lawyer can devote far more time to investigating your stop, challenging the breath test, and negotiating with the prosecutor.

Can I make payments?

Yes. We offer payment plans for DWI defense so you can hire experienced counsel without paying the entire fee on day one. Call (732) 303-7341 to discuss a plan that works for you.

What happens if I can’t afford a lawyer?

If you truly cannot afford a private lawyer, you can apply for a public defender through the municipal court — the judge will determine whether you qualify. What you should never do is face a DWI charge alone: the surcharges, license suspension, and insurance increases from a conviction will cost far more than a lawyer.

Does the fee change if my case goes to trial?

Our flat fees cover your case through trial — the price we quote is the price you pay. Many other lawyers charge a lower initial fee and then add a separate trial fee, so always ask whether the quote includes trial before you hire anyone.
